What is Revocation of Acceptance? According to section 5 of the Contract Act, an acceptance may be revoked at any time before its communication is as against the acceptor and not afterwards.
Illustration: A offers to sell his watch to B for Rs 500. B sends the letter of acceptance by post. B can revoke his acceptance by a telegram or telephonic message before the letter of acceptance reaches to A and not afterwards.
Communication of Revocation of Acceptance: The section 4 of the contract Act is relevant to a communication of revocation of acceptance and says that communication of revocation of acceptance is complete.
a) AS AGAINST THE ACCEPTOR; As against the person who makes it (acceptor), when It is put into a course of transmission to the person to whom it is made, so as to be out f then Of the person Who makes it. so we can say that before revocation of acceptance is complete as against the acceptor when the message of the revocation is put into the course of transmission.
(b) AS AGAINST THE PROPOSER: As against the person (proposer) to whom it is made, when – it comes to his knowledge. It means when the message of revocation of’ acceptance is received by the proposer, the communication of revocation} of acceptance is complete as against the proposer.
Illustration: B revokes his acceptance by a telegram. The communication of revocation of acceptance is complete as against B when the telegram is dispatched and as against A (proposer) when it is received and read by A.
“COMMUNICATION OF ACCEPTANCE”
According to section 4 of the Contract Act, the communication acceptance of a proposal is complete:
(a) as against proposer, when it is put in a cause of transmission to him, so as out of the power of the acceptor;
(b) as against the acceptor, when it comes to knowledge of the proposer.
(a) AS AGAINST PROPOSER: The communication of acceptance of a proposal JS complete as against the proposer when the acceptor sends the message of acceptance into a course of transmission to when the message of acceptance is sent to the proposer, now the proposer cannot take back his offer.
(b) AS AGAINST ACCEPTOR: The communication of acceptance is complete as against the acceptor when the message of acceptance comes to the knowledge of the proposer. Now the acceptor cannot take back his acceptance.
Illustration: (a) B accepts the proposal of A by letter. The communication of acceptance is complete as against A when the letter of acceptance is dispatched (posted) and against B when received and read by A.
(b) A accepts the proposal of B by a telegram. The communication of acceptance is completed as against B when A sends the telegram and as against A when B receives the telegram and reads it.
